I Do Care Less What Other Think About Me
But, here's a twist.
December 2002: The European Commission issues the Directive 2002/91/EC on the energy performance of buildings.
Having established that the energy used in the maintenance of the buildings of the residential and tertiary sector, accounting for more than 40% the final consumption of the EU Member States are required to formulate and implement a methodology for calculating the energy performance of buildings not only with respect to their heating, but also the production of hot water, lighting, ventilation and air conditioning in summer.
In particular, art. 7 is specified:
are granted 3 years for the adoption of the Directive. Among the first European countries to implement (some of which had already for years, individually legislated on this matter): Austria, Denmark, France, Germany, Ireland, Great Britain."Member States shall ensure that, when constructed, sold or rented a building, the energy performance certificate is made available to the prospective buyer or lessee, as the case (...)"
August 2005:
few months before the expiry of the transposition of Directive 2002/91/EC, the Italian government issues finally DM 178/2005, that the decree for the implementation of L10/91 (then 14 years later). At this point, however, the legislation is useless, and indeed, after a month and a half, the order will be replaced.
October 2005:
It 's the Decree 192/2005 implementing the European directive 2002/91/EC in Italy
The decree states:
- areas of application and the cases where the provisions of the release of energy certification;
- the functions of the regional and local authorities;
- the rules for the operation and maintenance;
- the collection of information, experience and industry studies;
- penalties for violations .
Above all, it introduces the "compliance clause" , that the following legislation and subsequent apply only in the regions and autonomous provinces that have not yet done so to transpose the European directive. In other words, the field of energy saving is a regional responsibility, notwithstanding the reference to 2002/91. The first region to enact on this matter, in 2007, Lombardy.
Unfortunately, the legislative decree 192/2005 does not contain the methodology for calculating the energy performance of buildings, or general criteria to which regions should refer to the energy certification, stating that they will be defined within 180 days from publication of decree.
February 2007:
is published Decree 311/2006, in addition to the legislative decree 192/2005.
addition to the calendar of dates of enforcement, the legislative decree includes a series of annexes, including tables showing the energy performance limits EP winter (to separate climate zones) and thermal transmittance values \u200b\u200bof the individual building components.
Here is the second "block". Some regions legislate on the subject, others are moving more slowly. The problem is that there are no national guidelines, there is a risk that, while referring to the same European directive, create discrepancies between the energy certification of the different regions.
To date, more than three years by Legislative Decree No. 192/2005, these guidelines have not yet been promulgated.

the end of 2008, the European Commission launched the infringement procedure to the Italian government for failing to comply with Directive 2002/91/EC on energy efficiency in buildings.
This latest episode in a long (17 years ) and bizarre story on the energy efficiency of buildings in our country, has followed a very complex, unlike other European nations.
Because it is made which, usually, the media do not pay much attention to better understand, let's history:
January 1991:
Entry into force of Law 10/1991 which " Rules for the Implementation of the National Energy on rational use of energy, energy conservation and developing renewable sources of energy. "
The law introduces, among other things:
- energy certification (!) ;
- municipal energy plans;
- the obligation of renewables in public buildings (!) ;
- the professional responsibility of Energy (Energy Manager) (!) ;
- the provision of capital grants in support of ' use of renewable energy in buildings and measures such as insulation, installation of heat pumps, installation of accounting systems in the consumption of heat (!) .
August 1993:
Exit DPR 412/93, which is not implementing in full the law 10/91, but only Article .4 " rules for the design, installation, operation of thermal systems in buildings in order to control energy . "
The order provides, among other things:
- Italian climatic zones;
- periods and during daily power plants;
- the minimum combustion efficiency of boilers (under which these should be replaced);
- technologies to use renewable sources of energy for public buildings.
At this point, something crashes. Some years passed, during which thousands of technical reports asseveranti compliance with the energy demand for space heating (necessitated, for example, in the case of upgrading a property), prescribed by Presidential Decree 412/93, accumulate in the technical department Italian communes, waiting to be examined by a competent person.
