The strange and curious history of the Energy Certification in Italy (2nd part)

December 2002:
The European Commission issues the Directive 2002/91/EC on the energy performance of buildings.

Having established that the energy used in the maintenance of the buildings of the residential and tertiary sector, accounting for more than 40% the final consumption of the EU Member States are required to formulate and implement a methodology for calculating the energy performance of buildings not only with respect to their heating, but also the production of hot water, lighting, ventilation and air conditioning in summer.

In particular, art. 7 is specified:

"Member States shall ensure that, when constructed, sold or rented a building, the energy performance certificate is made available to the prospective buyer or lessee, as the case (...)"

are granted 3 years for the adoption of the Directive. Among the first European countries to implement (some of which had already for years, individually legislated on this matter): Austria, Denmark, France, Germany, Ireland, Great Britain.

August 2005:
few months before the expiry of the transposition of Directive 2002/91/EC, the Italian government issues finally DM 178/2005, that the decree for the implementation of L10/91 (then 14 years later). At this point, however, the legislation is useless, and indeed, after a month and a half, the order will be replaced.

October 2005:
It 's the Decree 192/2005 implementing the European directive 2002/91/EC in Italy
The decree states:

• areas of application and the cases where the provisions of the release of energy certification;
• the functions of the regional and local authorities;
• the rules for the operation and maintenance;
• the collection of information, experience and industry studies;
• penalties for violations .

Above all, it introduces the "compliance clause" , that the following legislation and subsequent apply only in the regions and autonomous provinces that have not yet done so to transpose the European directive. In other words, the field of energy saving is a regional responsibility, notwithstanding the reference to 2002/91. The first region to enact on this matter, in 2007, Lombardy.

Unfortunately, the legislative decree 192/2005 does not contain the methodology for calculating the energy performance of buildings, or general criteria to which regions should refer to the energy certification, stating that they will be defined within 180 days from publication of decree.

February 2007:
is published Decree 311/2006, in addition to the legislative decree 192/2005.
addition to the calendar of dates of enforcement, the legislative decree includes a series of annexes, including tables showing the energy performance limits EP winter (to separate climate zones) and thermal transmittance values \u200b\u200bof the individual building components.

Here is the second "block". Some regions legislate on the subject, others are moving more slowly. The problem is that there are no national guidelines, there is a risk that, while referring to the same European directive, create discrepancies between the energy certification of the different regions.

To date, more than three years by Legislative Decree No. 192/2005, these guidelines have not yet been promulgated.
